Codelco Exposes Irregularities in Belaz-Movitec Spa Lawsuit: A Comprehensive Investigation
In a bold move, Codelco, the National Copper Corporation of Chile, has announced that it will provide all the necessary evidence to the Public Prosecutor’s Office regarding the irregularities that occurred during the legal proceedings with the Belaz-Movitec Spa Consortium (CMB). This decision comes after a series of events that have raised concerns about the fairness and transparency of the judicial process.
The Dispute and Its Aftermath
The conflict between Codelco and CMB began in March 2021, when the latter was awarded a contract for works at the Rajo Inca mine. However, due to repeated non-compliance, Codelco decided to terminate the contract prematurely. This decision led CMB to file a writ of protection, alleging a violation of property rights and the right to develop its economic activity
.
The Court of Appeals of Copiapó rejected CMB’s writ, but the consortium persisted and took the case to the Supreme Court, where it was surprisingly accepted. This is one of the key points that the Supreme Court’s president, Ángela Vivanco, will need to explain.
Codelco’s Response and Commitment to Transparency
In a statement, Codelco has made it clear that it has exercised all the rights, resources, and actions granted by law to try to reverse the irregularities that have been verified in the processing and knowledge of the writs of protection filed by CMB before the Supreme Court. Furthermore, the Corporation has exposed this situation to the Ethics Commission of the Supreme Court through its legal representative and is actively collaborating to ensure that the anomalies that gave rise to the judicial rulings against the Corporation are clarified.
Seeking Justice and Defending Interests
Codelco has stated that it will continue to collaborate with the courts of justice and will provide all the necessary background information to the Public Prosecutor’s Office, so that it can investigate the facts that may constitute a crime, as well as evaluate new legal actions that aim to defend the interests of the Corporation.
Conclusion
Codelco’s decision to provide all the evidence to the Public Prosecutor’s Office and to explore new legal avenues demonstrates its commitment to transparency and the pursuit of justice. This move is a clear signal that the Corporation will not tolerate any irregularities or attempts to undermine its interests, and is willing to take all necessary steps to protect its reputation and safeguard its operations.
